1 Scope & Acceptance

These Terms of Use (“Terms”) govern your access to and use of all apps, games, websites, digital content, and related services published, operated, or made available under the developer, publisher, or brand names QBeSoft, PixoPlay, and Trident Pixels (collectively, the “Services”).

• These Terms apply to all such Services distributed through the Google Play Store, the Apple App Store, and any related websites or web services, unless a separate service-specific agreement is presented.
• By installing, accessing, or using any of the Services, you agree to be bound by these Terms.
• If you do not agree to these Terms, do not install, access, or use the Services.
• Additional terms may apply to specific features, offers, contests, subscriptions, reward systems, withdrawal systems, or promotions. If there is a conflict, those additional terms will prevail for that specific feature.

3 Eligibility & Accounts

• You must be able to form a binding contract under applicable law to use the Services. If you are under the age of majority, you may use the Services only with the consent and supervision of a parent or legal guardian.
• Parents or guardians are responsible for the activities of minors using the Services under their supervision.
• When creating an account or profile, you must provide accurate and up-to-date information and keep it current.
• You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account or device.
• We may refuse, suspend, or reclaim usernames or account identifiers that are inappropriate or infringe the rights of others.

4 License to Use the Services

Subject to your compliance with these Terms, we grant you a limited, personal, non-exclusive, non-transferable, non-sublicensable, revocable license to install and use the Services on devices you own or control, solely for your personal, non-commercial use, unless we expressly permit otherwise.

You agree that you will not:

• Copy, distribute, publicly display, or publicly perform the Services except as expressly allowed.
• Modify, translate, adapt, or create derivative works of the Services.
• Reverse engineer, decompile, disassemble, or otherwise attempt to derive source code, except where permitted by law.
• Rent, lease, sell, sublicense, or otherwise transfer the Services or any rights in them.

All rights not expressly granted to you are reserved by QBeSoft, PixoPlay, Trident Pixels, and their licensors.

5 Intellectual Property

• The Services, including all apps, games, software, code, graphics, logos, artwork, music, animations, text, layouts, and designs, are protected by intellectual property laws worldwide.
• Trademarks, logos, and trade dress of QBeSoft, PixoPlay, and Trident Pixels may not be used without prior written permission, except as allowed by law or platform policies.
• You may not remove, obscure, or alter any copyright, trademark, or other proprietary notices contained in the Services.

6 User Content & Community Rules

Some Services may allow you to create, upload, post, store, or share content such as usernames, scores, screenshots, chat messages, submissions, reviews, custom content, or other materials (“User Content”).

You retain ownership of your User Content. However, you grant QBeSoft, PixoPlay, and Trident Pixels a worldwide, non-exclusive, royalty-free, sublicensable, and transferable license to host, store, reproduce, adapt, modify, publish, translate, create derivative works from, distribute, publicly perform, and display such User Content in connection with operating, improving, securing, and promoting the Services.

Community Rules

You agree not to use the Services to:

• Engage in harassment, bullying, hate speech, threats, or any content that is discriminatory, violent, abusive, or otherwise harmful.
• Share sexually explicit content, illegal content, or content involving minors.
• Impersonate any person or entity or misrepresent your affiliation with any person or entity.
• Violate privacy or publicity rights of others, including sharing personal or confidential information without consent.
• Upload or distribute viruses, malware, or any other harmful code or content.
• Infringe copyrights, trademarks, or other intellectual property rights.

We may, but are not obligated to, monitor or moderate User Content. We reserve the right to remove, disable, restrict, or report any User Content at our sole discretion where legally permitted.

7 Fair Play, Anti-Cheat & Security

You agree to use the Services fairly and not to exploit them.

• Do not use bots, automation, scripts, exploits, cheats, trainers, click manipulation, or unauthorized third-party tools that interact with the Services.
• Do not modify, hack, or interfere with the Services, servers, or networks.
• Do not attempt to gain unauthorized access to accounts, systems, or data.
• We may implement technical and operational measures to detect and prevent cheating, fraud, abuse, fake referrals, fake installs, or reward manipulation.

If we suspect cheating, fraud, or abuse, we may take enforcement actions including warnings, temporary or permanent bans, score resets, reward reversals, withholding withdrawals, account review, or other measures we deem appropriate.

8 Third-Party Services & Links

The Services may contain links to third-party websites or integrate third-party SDKs and services such as authentication providers, analytics tools, cloud services, advertising networks, payment processors, survey platforms, attribution providers, or offerwall partners.

• These third parties operate under their own terms and privacy policies. We are not responsible for their content or practices.
• Your use of third-party services is at your own risk. Review their terms and policies before using them.

9 Purchases, Subscriptions & Refunds

Some Services offer in-app purchases or subscriptions. Payments are generally processed by the relevant app store or payment channel, such as Google Play or the App Store, under their billing rules and policies.

• Prices, features, availability, and supported payment methods may change from time to time.
• Subscriptions may automatically renew at the end of each billing period unless you cancel them in your platform account settings before the renewal date.
• Free trials may convert to paid subscriptions unless you cancel before the trial period ends.
• Refunds are typically handled by the platform or payment provider, subject to their policies, unless applicable law requires direct handling.

We may offer limited-time promotions or discounts. Such offers are subject to additional terms and may be withdrawn, replaced, or modified at any time.

10 Payment Terms for Earnings, Withdrawals & Referrals

Some Services may allow eligible users to earn rewards, credits, commissions, cashback, bonuses, referral incentives, or similar promotional amounts through offers, referrals, tasks, app usage, surveys, gameplay, or other qualifying activities. Any such rewards are subject to these Payment Terms.

General Payment Rules

• All withdrawal requests are subject to account verification, fraud checks, compliance review, and successful completion of all eligibility requirements.
• Submitting a withdrawal request does not guarantee approval or payment.
• We may delay, hold, reject, reverse, or cancel any withdrawal request where we detect suspicious activity, duplicate accounts, fake referrals, self referrals, abuse, chargebacks, offer manipulation, policy violations, technical errors, or missing eligibility requirements.
• Availability of earning features and withdrawals may vary by app, country, platform, payment method, and account status.
• Estimated balances, pending rewards, or in-app earnings do not become payable until they are fully verified and marked eligible for withdrawal under the applicable Service rules.

Referral Requirement for Withdrawals

• A “valid referred friend” means a genuine new user referred by you who meets all applicable qualification requirements defined by the relevant Service.
• Qualification requirements may include account registration, first login, app install retention, verification, task completion, first eligible activity, or other in-app actions.
• Self-referrals, duplicate accounts, fake accounts, emulator-generated accounts, device farms, incentivized fraud, VPN or proxy abuse, or manipulated referral activity will not count as valid referrals.
• If one or more referrals are later found invalid, previously granted withdrawal eligibility may be suspended, withheld, reversed, or revoked.

Withdrawal Processing

• Withdrawal requests may be processed manually or automatically, depending on the Service.
• Verification and withdrawal processing may take up to 90 days.
• Processing times are estimates only and may vary based on verification, provider delays, platform issues, banking delays, holidays, transaction review, request volume, or compliance checks.
• Users are responsible for providing complete and accurate payout details. We are not responsible for failed payments caused by incorrect payout details submitted by the user.
• Where legally required, we may request additional identity, tax, fraud-prevention, age, or eligibility information before approving a payment.

Payment Methods

Available withdrawal methods may vary by app, country, and user eligibility. Supported methods may include bank transfer, UPI, PayPal, Stripe-supported methods, Payoneer, gift cards, or other methods offered within the applicable Service.

Right to Refuse or Reverse Payments

• We reserve the right to refuse, withhold, adjust, cancel, or reverse any reward, earning, referral bonus, or withdrawal if we determine, in our sole reasonable discretion, that it resulted from fraud, abuse, error, policy violation, ineligible activity, missing referral requirements, or violation of platform rules.
• We may suspend withdrawal features entirely for accounts under investigation.
• Accounts using self referrals, fake referrals, manipulated credits, suspicious reward activity, duplicate accounts, or invalid payout details may lose withdrawal eligibility.

These Payment Terms apply in addition to the main Terms of Use, any in-app rules, and any payout, campaign, or offer-specific conditions shown inside the relevant Service.

11 Virtual Items & Currencies

Some Services may include virtual items, coins, points, credits, gems, energy, skins, or similar digital content (“Virtual Items”).

• Virtual Items may have no real-world monetary value unless a specific feature expressly states otherwise under separate payout rules.
• They are personal, limited, non-transferable, and for use only within the applicable Service unless a specific withdrawal or redemption feature is expressly offered.
• They may be earned through gameplay, tasks, offers, referrals, or purchased via supported platforms where offered.
• They may be modified, limited, discontinued, corrected, or revoked by us at any time to maintain balance, integrity, security, or legal compliance.

We are not responsible for loss of Virtual Items or progress caused by device issues, uninstallations, failed sync, unsupported transfers, or account misconduct.

12 Online Features & Leaderboards

Some Services may offer online features such as multiplayer modes, cloud saves, events, rankings, social features, or leaderboards.

• Such features require a stable internet connection and compatible device or platform account.
• We may moderate, reset, or remove scores or rankings suspected to result from cheating, fraud, abuse, or technical issues.
• We may modify, suspend, or discontinue online features at any time for maintenance, operational, legal, or business reasons.

13 Betas, Trials & Test Builds

From time to time, we may offer early access, beta versions, test builds, staged rollouts, or experimental features. These may be incomplete, unstable, or contain more bugs than normal releases.

• Features, progress, balances, and Virtual Items in beta or test builds may be changed, reset, or removed at any time.
• We may collect additional diagnostics or feedback to improve pre-release versions.
• Access to beta or test builds may be limited and can be revoked at our discretion.

14 Promotions & Contests

Promotions, events, giveaways, campaigns, referral programs, or contests run by QBeSoft, PixoPlay, or Trident Pixels may be subject to separate official rules. In case of a conflict between those rules and these Terms, the specific promotion rules will govern for that promotion.

15 Device Permissions & Connectivity

Some features of the Services may require access to certain device functions such as notifications, storage, camera, microphone, sensors, advertising identifiers, or location.

• Permission requests may be presented by your device, operating system, or the app itself, and you can accept or deny them, subject to feature limitations.
• You can usually change or revoke permissions later in your device settings.
• Your network operator or internet provider may charge data fees for using online features.

16 Open-Source Components

The Services may contain or use open-source software components. Each component is licensed under its own terms. Where required, acknowledgements and license texts may be provided within the app, project files, or associated documentation.

17 Copyright / DMCA

If you believe that material within the Services infringes your copyright or other rights, contact us at support@tridentpixels.com with:

• Your full name and contact details.
• A description of the copyrighted work or other right that you claim has been infringed.
• The exact location of the allegedly infringing material, such as the app name, URL, feature, or screenshot.
• A statement that you have a good-faith belief that the use is not authorized by the rights owner, its agent, or the law.

We may remove or restrict access to content while we investigate such notices and may take other appropriate actions.

18 Disclaimers

THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED. TO THE MAXIMUM EXTENT PERMITTED BY LAW, QBESOFT, PIXOPLAY, AND TRIDENT PIXELS DISCLAIM ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

We do not guarantee that the Services will be uninterrupted, error-free, secure, profitable, continuously available, or compatible with every device, region, or configuration, or that defects will always be corrected.

19 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, QBESOFT, PIXOPLAY, TRIDENT PIXELS, AND THEIR DIRECTORS, EMPLOYEES, CONTRACTORS, AFFILIATES, PARTNERS, AND LICENSORS ARE NOT LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, GOODWILL, REWARDS, BUSINESS OPPORTUNITY, OR DEVICE USE, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF OR INABILITY TO USE THE SERVICES, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

TO THE EXTENT LIABILITY CANNOT BE EXCLUDED, THE TOTAL AGGREGATE LIABILITY OF QBESOFT, PIXOPLAY, AND TRIDENT PIXELS FOR ALL CLAIMS RELATING TO THE SERVICES WILL BE LIMITED TO THE AMOUNT YOU PAID, IF ANY, FOR THE RELEVANT SERVICE DURING THE TWELVE (12) MONTHS PRIOR TO THE EVENT GIVING RISE TO THE CLAIM, OR THE MINIMUM AMOUNT REQUIRED BY LAW.

20 Indemnity

You agree to indemnify, defend, and hold harmless QBeSoft, PixoPlay, Trident Pixels, and their affiliates, officers, directors, employees, agents, contractors, and licensors from and against any claims, liabilities, damages, losses, and expenses, including reasonable legal fees, arising out of or in any way connected with:

• Your access to or use of the Services.
• Your violation of these Terms or any applicable law or platform policy.
• Your User Content or your infringement of any third-party rights.
• Your fraud, abuse, fake referrals, fake installs, or misuse of earnings or withdrawal systems.

21 Governing Law & Disputes

Unless otherwise required by the laws of your country or region, these Terms and any dispute or claim arising out of or in connection with them or the Services will be governed by and construed in accordance with the laws of the jurisdiction in which the applicable publisher brand is established, without regard to conflict of law principles.

You and the applicable publisher brand agree to submit to the non-exclusive jurisdiction of the courts of that jurisdiction to resolve any dispute arising out of or relating to these Terms or the Services, except where applicable law gives you the right to bring your claim elsewhere.

22 Suspension & Termination

We may suspend or terminate your access to all or part of the Services at any time, with or without notice, if we reasonably believe that:

• You have violated these Terms or other applicable policies.
• Your use poses a security, technical, fraud, platform, or legal risk to us or others.
• We discontinue the Service for business, legal, technical, or compliance reasons.

Upon termination, all rights granted to you under these Terms will immediately cease, and you must stop using the Services. Certain sections will survive termination, including those relating to intellectual property, payment disputes, disclaimers, limitation of liability, indemnity, governing law, and dispute resolution.

23 Changes to These Terms

We may update these Terms from time to time, including to reflect changes in the Services, platform requirements, legal obligations, payout rules, or business practices.

• When we make material changes, we will update the effective date and version number at the top of this page.
• In some cases, we may also provide additional notice within the applicable app, website, or service.

Your continued use of the Services after the updated Terms become effective constitutes your acceptance of them.

24 Miscellaneous

• Severability: If any provision of these Terms is found to be invalid or unenforceable, that provision will be enforced to the maximum extent permitted, and the remaining provisions will remain in full force.
• No waiver: Our failure to enforce any right or provision of these Terms will not be considered a waiver of such right or provision.
• Assignment: You may not assign or transfer these Terms or your rights or obligations under them without prior written consent. We may assign these Terms in connection with a merger, acquisition, corporate restructuring, or sale of assets, or by operation of law.
• Entire agreement: These Terms, together with any additional terms referenced herein, the Privacy Policy, and the Payment Terms, constitute the entire agreement between you and QBeSoft, PixoPlay, and Trident Pixels regarding the Services.
